TERMS AND CONDITIONS OF USE — CYCLING CONQUEST

1. ACCEPTANCE
By creating an account, downloading or using the Cycling Conquest application (the "App") and the services provided by Coffee Peaks Cycling SAS ("Coffee Peaks", "we"), you accept these Terms and Conditions, together with our Privacy Policy. If you do not agree, please refrain from using the service.
2. DESCRIPTION OF THE SERVICE
Cycling Conquest is a geographic gamification app for cyclists. Based on GPX files that the user voluntarily uploads or that are imported from authorized sports services, we compute a "conquered territory" polygon over real administrative regions. The service includes rankings, private clubs, challenges and a badge system.
Cycling Conquest does NOT offer:
• Structured training plans.
• Personalized coaching recommendations.
• Medical diagnostics or professional sports advice.
• Real-time assistance during a ride.
3. REGISTRATION AND ACCOUNT
• You must be at least 14 years old to create an account.
• You are responsible for keeping your password confidential.
• You must provide truthful and up-to-date information when registering.
• One account corresponds to one natural person; shared or automated accounts are not allowed.
4. ACCEPTABLE USE
You agree to:
• Upload only real outdoor activities.
• Not upload indoor, virtual (Zwift, Rouvy, TrainerRoad, etc.) or artificially generated activities, or routes belonging to other people.
• Not manipulate GPX files to artificially inflate your territory or statistics.
• Respect other community members in rankings, clubs and comments.
• Not use the App for illegal purposes or in ways that infringe third-party rights.
Non-compliance may result in suspension or deletion of your account without prior notice.
5. USER CONTENT
You retain ownership of the GPX files and activities you upload to the platform. By uploading them you grant us a worldwide, non-exclusive, royalty-free and revocable license to process, store and display such content within the App, solely for the purposes described in our Privacy Policy.
Your information is NOT used for advertising or to train artificial intelligence models.
6. INTEGRATIONS WITH THIRD-PARTY SERVICES
If you connect your Garmin Connect, Strava, Wahoo or other sports service account, you do so under the OAuth flow with your explicit consent. We only import the activities needed to compute your territory.
Each service has its own terms. In particular, data coming from Strava is subject to its usage restrictions: such data will not be shown to other users, only to you.
7. SUBSCRIPTIONS AND PREMIUM FEATURES
Cycling Conquest operates on a freemium model. Some cosmetic features, premium challenges and enhanced experiences may require the purchase of virtual "Coins" or subscriptions. Specific conditions will be shown before any transaction. Payments are processed through Apple App Store, Google Play or authorized processors, and are governed by their policies.
8. INTELLECTUAL PROPERTY
The App, its code, designs, trademarks, logos, badge system, game mechanics and other elements are property of Coffee Peaks Cycling SAS or its licensors. No license or right is granted over these elements beyond normal use of the service.
9. LIMITATION OF LIABILITY
Use of the App is at your own risk. Coffee Peaks is not responsible for:
• Injuries, accidents or incidents that occur during your cycling outings.
• Decisions regarding routes, navigation or road safety based on information from the App.
• Temporary service interruptions, maintenance or third-party provider outages.
• Loss, alteration or exposure of data due to security incidents outside our reasonable control.
To the maximum extent permitted by law, our total cumulative liability will never exceed the amount actually paid by the user during the twelve (12) months prior to the incident.
10. SERVICE MODIFICATIONS
We reserve the right to modify, suspend or discontinue any part of the service at any time, with or without prior notice. We will notify material changes to these Terms at least 15 days in advance.
11. TERMINATION
You can delete your account at any time from the Profile section of the App. Coffee Peaks may suspend or terminate your account if you breach these Terms.
12. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved before the competent judges at the consumer's domicile, unless applicable law provides otherwise.
